When is a pool safety certificate required?
You must have a valid pool safety certificate if you are selling, buying, or leasing a property with a regulated pool.
How long does a certificate last?
For non-shared (private residential) pools, the certificate is valid for 2 years. For shared pools (units, complexes), it is valid for 1 year.
What if I sell without a certificate?
If you do not have a certificate when selling, you must provide the buyer with a Notice of No Pool Safety Certificate (Form 36) before settlement. The buyer then has 90 days to obtain a certificate.
What happens if the pool fails inspection?
You will receive a nonconformity notice. You have 3 months to rectify the issues and have the pool re-inspected by the same inspector.
A pool safety inspector is not required to give the pool owner a nonconformity notice if:
• they reinspect the pool within two days after initial inspection and are satisfied that the pool now complies,
or
• the owner and pool safety inspector agree that the pool safety inspector will carry out minor repairs within 20 business days of the original inspection, and the pool safety inspector has carried out the repairs.
If the agreed minor repairs are not undertaken by the pool safety inspector within 20 business days, or if they
reinspect the pool within the two days and are not satisfied it complies, the pool safety inspector must, within a further two business days, give a nonconformity notice to the pool owner.
Are fences required for all pools?
Yes, all pools and spas containing more than 30cm of water require compliant fencing. This includes inflatable pools if they are deep enough.
What are the basic fencing requirements?
Fences must be at least 1200mm high, with no climbable objects within 900mm of the top rails (non-climbable zone) and a maximum gap of 100mm below the fence.
Is a CPR sign necessary?
Yes, a current CPR sign must be displayed in the pool area, usually near the shallow end.
Who can inspect my pool?
Only a licensed Pool Safety Inspector can issue a certificate.
How do I get a Pool inspected in a Remote Area?
We can assist you in getting your pool or spa inspected via a video call. You will need to be able to help with the process of measurements and tests needed for the Form 23.
Local councils have the authority to declare specific areas as "remote" to reduce the financial burden on pool owners.
- Remote Inspection Process: If a pool is in a declared remote area, special arrangements may apply to the inspection process.
- Compliance Still Necessary: Even in remote areas, a pool safety inspector must be engaged to inspect the pool and ensure it meets the required safety standards.
